What the bemotrizinol decision actually changed, and what it does not mean for peptides

Cov cuab yeej tseem ceeb vim nws piav qhia txog qhov hnyav ntawm cov pov thawj. Bemotrizinol tau nkag mus rau Monograph M020 los ntawm ib qho kev txiav txim kawg hauv kev tswj hwm raws tshooj 505G(y)(1) ntawm Food and Drug Act, luam tawm hauv Federal Register notice ntawm 10 June 2026. Qhov txheej txheem pib nrog ib qho Tier 1 OTC Monograph Order Request from DSM Nutritional Products LLC, announced in the December 2025 proposed order, and the final order grants that company and its licensees an 18-month exclusivity period from the effective date, u the final administrative order itself.
The conditions of use show how specific a monograph entry is. Under the amended monograph, a finished product must reach a minimum SPF of 2, may not combine bemotrizinol with aminobenzoic acid or trolamine salicylate, and is limited to oil, lotion, cream, gel, butter, paste, ointment, stick and spray forms where the propellant never contacts the formulation. FDA’s own framing, including the HHS Secretary’s comment that the ingredient “has been used safely in Europe for decades,” appears in FDA’s announcement.

Before you commission a single study, answer three questions in writing:
-
What exactly will the label and marketing claim the product does?
-
Does any claim cross into affecting structure or function, or preventing a condition?
-
If the answer to question two is yes, which drug requirements will the product carry?
Confirm the classification with regulatory counsel before the evidence plan is fixed. Reclassifying after the studies are designed usually means repeating them.
The five things a peptide data package must prove
The framework is not ours to invent, and it is not an FDA rule for cosmetics. It follows the logic of ICH Q2(R2)’s fit-for-purpose standard, which requires a validation protocol written before the study and treats identity, purity, assay and impurity testing as separate procedure types. The edition in force is the March 2024 final version, which replaced the older Q2(R1) framework. For cosmetic peptides this is borrowed logic, applied because it works, not because the law demands it.
The scope of “peptide” is wider than many formulators assume. A 2026 peer-reviewed safety framework for cosmetic peptides defines a peptide as a polymer of up to 40 amino acids, kwv yees 4.4 kDa, and notes that historically cosmetic peptides have sat below 500 Da, around five residues. It also lists the modifications that must be defined rather than assumed: D-amino acids, glycosylation, and fatty-acyl conjugation at the N-terminus.
Identity: confirming the molecule, not the trade name
Identity is a separate procedure type under Q2(R2), and it is the claim most often satisfied by a trade name and a certificate. That is not identity.
Ask for mass confirmation against theoretical mass by LC-MS, plus a second orthogonal technique. A single mass measurement tells you the dominant species has the expected mass; it does not tell you the material is pure or that the content is right. Mass spectrometry also confirms mass and fragmentation pattern, not stereochemistry, so a sequence containing D-amino acids needs its own evidence.
The sequence itself belongs in the package as a change-controlled document with a version history. An N-terminal modification is part of the molecule’s identity, not a cosmetic detail, so a palmitoylated peptide and its unmodified parent are different substances with different identity records.
Kev huv si: what an HPLC percentage leaves out
An area-percent figure from reversed-phase HPLC is a relative measure produced Real Peptides by one method on one instrument. It is not a property of the lot in isolation.
The number means something only alongside the method it came from: column, gradient, qhov ntev ntawm kev kuaj pom, reference standard and the lot-linked chromatogram. Without those, a reviewer cannot re-examine the result, thiab a 98 percent figure cannot be distinguished from a 95 percent one measured under different conditions. Area percent also cannot separate co-eluting truncation from oxidation without orthogonal evidence, which is why the chromatogram matters more than the headline.
Ask for the chromatogram and the method description, not the summary number. If the supplier cannot produce a lot-specific chromatogram, the purity claim is unverifiable regardless of its value. The validation protocol Q2(R2) requires should also exist before the study, not be reconstructed afterwards.
Content and counterion: why net peptide per milligram is a separate number
Net peptide content is the mass of peptide per milligram of material, and it is not the same as purity. A 95 percent pure lot can still deliver far less peptide per milligram than the formulator assumes.
Two things sit between purity and content. Water, measured by Karl Fischer, and the counterion. Counter ions are an impurity class to characterise, and the framework names acetic acid as an example. In practice the counterion is often trifluoroacetate, and trifluoroacetate is heavy: it adds mass that is not peptide. Our own cosmetic peptide documentation treats trifluoroacetate as the default and offers acetate, chloride and ammonium exchange, because the counterion changes the net peptide figure per milligram and the formulator needs the number that matches the salt actually shipped. Planetpeptide
Determine peptide content with a suitable quantitative method, such as validated amino-acid analysis, qNMR or another justified assay. State the water, counterion and reporting basis where relevant; amino-acid analysis is not the only permissible method.
h: designing the study before the launch date
Stability is a study design problem, and the design has to be fixed before the launch date is set. Retrofitting timepoints after a launch plan exists is how programmes end up with data that cannot support the shelf life claimed.
The stress-testing logic in ICH Q1A(R2) is the right starting framework. ICH Q1A(R2)’s stress-testing purpose is to identify likely degradation products, establish degradation pathways and intrinsic stability, and validate that the analytical methods can actually detect change. Conditions include temperatures 10 °C above the accelerated condition, humidity, oxidation, photolysis, and hydrolysis across a wide pH range.
Design the finished-formulation stability study around its composition, ntim khoom, storage conditions and proposed shelf life. Pharmaceutical Q1A(R2) conditions may inform a study where justified; its submission durations, batch counts and significant-change definitions are not automatic cosmetic requirements.
These are drug-substance and drug-product conditions, borrowed as a framework. Cosmetics are not bound by them, and a cosmetic peptide programme can justify a lighter design. What it cannot do is skip the design step. Decide the storage conditions, the timepoints, the attributes tested and the acceptance criteria in writing, and make sure the methods used are stability-indicating before the first sample goes on test.
Callout: what the sunscreen order shows about thin stability data. FDA’s rejection of the aerosol spray data turned on exactly these elements: too short a study, no release-time results, storage conditions without humidity, and assay results close to the acceptance limit with no baseline to interpret them. A cosmetic peptide dossier will not be reviewed by FDA in the same way, but the same gaps make a package unreadable to any technical reviewer.
Where the peptide’s function can be measured, Q5C’s potency logic is worth borrowing: when intended use is linked to a measurable biological activity, potency testing belongs in the stability studies. Q5C itself applies to well-characterised proteins and polypeptides from biological sources, not to synthetic cosmetic peptides, so treat the principle as a design input rather than a requirement.
Labeling: getting the name and the order right
For US ingredient declarations, use the name required by the applicable labeling rules, including established or common/usual names and the relevant naming hierarchy. Parenthetical international alternatives may be acceptable in some cases, but every ingredient does not universally require a second INCI name in parentheses.
Ordering follows the 1%-and-below rule that lets peptide traces sit in any order. Ingredients are listed in descending order of predominance, and anything at 1 percent or less may be listed in any order after those above 1 feem pua. Proprietary “X (thiab) Y” mixtures must be split into their components, which matters when a peptide arrives as a pre-blended stock.
The minimum connected data package, field by field
A connected data package is a set of lot-specific records that a reviewer can follow from the certificate of analysis back to the raw data. A certificate of analysis on its own is a summary, and a summary is not a package.
The connecting thread is data integrity. MHRA’s data-integrity guidance sets out the attributable, nyeem tau yooj yim, tam sim no, original, accurate principles, extended by complete, sib haum xeeb, ruaj khov thiab muaj, and states there is no difference in expectations whichever acronym is used. Raw data is the original record. If the chromatogram in the dossier cannot be traced to the run that produced it, the record is not connected.
Callout: the CoA-only answer. T, h a u. m.
Electronic records raise the bar further if the product crosses into drug territory. t u, s. For a cosmetic-only product this is a useful benchmark rather than an obligation, n.
Qualifying a peptide supplier before a U.S. launch
e: can this supplier produce lot-specific evidence on request, and does the evidence connect? Facility size and portfolio breadth do not answer it.
Our standard cosmetic peptide documentation pairs analytical HPLC for purity, mass spectrometry rau kev txheeb xyuas, and peptide content with a certificate of analysis, chromatogram and mass spectrum for the lot. Counterion analysis, water content by Karl Fischer, endotoxin testing and optical rotation are available as additions. What matters in qualification is not the list but whether you can obtain it for the specific lot and whether the underlying method descriptions come with it.
Three checks we suggest running before an order:
-
Ask for a lot-specific package, not a template. Request the chromatogram, spectrum and content result for the lot you would receive, and compare the lot number across every document. Polypeptid Supplier
-
Ask how the sequence is controlled. A change-controlled sequence document with modification history tells you whether an N-terminal change would reach you as a new identity or as a silent substitution.
-
Ask what happens at scale-up. Purity and content can shift between milligram and kilogram scale, so ask for the analytical results from the largest scale run available and for the per-step testing that supports them.
Callout: tech-transfer risk. A package that is complete at small scale and silent at production scale leaves the brand developer carrying the risk. Ask which analytical results exist at the scale you will buy, and whether the method transfers with the process.
Txoj cai txiav txim: what to require before you commit
Do not commit to a peptide launch on a purity figure. Commit when the five claims are each supported by lot-specific, cov pov thawj txuas ntxiv, thiab tsis yog ua ntej.

Cov Lus Nug Nquag Nug
Puas yog qhov kev txiav txim bemotrizinol tsim txoj kev rau peptide muaj zog hauv Asmeskas?
PM. The order amended an existing OTC sunscreen monograph under section 505G(y)(1) and applies to one UV filter under defined conditions. It establishes no pathway, category or precedent for peptides, cosmetic or otherwise. The transferable lesson is the evidence standard, not the legal route.
Puas yog peptide raug tswj hwm raws li tshuaj hauv Asmeskas?
PM. FDA classifies by intended use, so the same peptide can be a cosmetic, a drug, or both depending on what the product claims. A product with both cosmetic and drug intended uses must comply with both sets of requirements, and there is no “cosmeceutical” category in U.S. txoj cai.
Yog 98 feem pua HPLC huv txaus rau ib qho Asmeskas. launch?
It is one of five claims, and on its own it is not enough. A purity figure says nothing about identity, net peptide content, stability or whether the method was fit for purpose. Thov chromatogram, the method description and the content result alongside it.
Dab tsi yog qhov txawv ntawm huv thiab net peptide ntsiab lus?
Purity is a relative measure of how much of the detected material is the target peptide. Net peptide content is the mass of peptide per milligram of the material, after water and counterion are accounted for. A high-purity lot with a heavy counterion can deliver substantially less peptide per milligram than the purity figure suggests.
Puas yog cov peptides zoo nkauj yuav tsum ua raws li ICH ruaj khov?
PM. ICH Q1A(R2) and Q5C are drug and biological-product guidelines and are not legally binding on cosmetics. Their logic is still worth borrowing, because a stability protocol designed on those principles answers the questions a technical reviewer will ask.
Dab tsi yuav tsum muaj hauv daim ntawv pov thawj tshuaj xyuas peptide?
s, the lot number, the analytical results for identity, purity and content, the methods used, and the specification each result is measured against. It should be accompanied by the lot-specific chromatogram and mass spectrum, and traceable to the underlying raw data.
Xaus lus
The bemotrizinol milestone is worth reading closely, but not as a sign that peptide access just got easier. It is a demonstration that U.S. access follows a connected, claim-by-claim data package, and that a submission is judged on the completeness of its evidence rather than the promise of its molecule. g, that is a higher bar than most current documentation clears, and it is the right one to adopt before a launch date is set.
The practical takeaway is the decision rule: five claims, five sets of evidence, one connected record per lot. Classification first, then identity, purity, content, stability and assay suitability, each with the method and the raw data behind it. A supplier who can meet that standard for the lot you are buying is a supplier you can build a U.S. launch on.
At MOL Changes we supply cosmetic peptides from milligram research quantities to kilogram scale, with analytical HPLC, mass spectrometry and peptide content results issued against the lot, and counterion, water content and endotoxin testing available where the application needs them. If you are assembling a documentation package ahead of a U.S. launch, send us your requirements and we will walk through what the lot records contain.
